What Needs Care Is the Day After, Not the Contract

계약서에 서명하고 잔금을 치르면 끝난 것처럼 느껴집니다. 그런데 한국에서 보증금을 지키는 힘은 계약서가 아니라 신고에서 나옵니다. 주택을 넘겨받고 주소를 등록하고 확정일자를 갖추면 그다음 날 0시부터 권리가 생깁니다.
Signing the contract and paying the balance feels like the end of it. But in Korea what protects your deposit comes from the filings, not the contract. Once you have taken possession, registered your address, and obtained the fixed date stamp, your rights take effect from 00:00 the following day.

What to Check Before You Sign

계약서를 쓰기 전에 확인할 것은 세 가지입니다. 집이 누구 것인지, 그 집에 빚이 얼마나 걸려 있는지, 돈을 어디로 보내는지입니다.
Three things to check before writing a contract: who owns the place, how much debt is attached to it, and where your money is going.

부동산을 통해 계약하면 이 확인은 중개사가 합니다. 등기부등본을 떼어 와 소유자와 근저당을 설명해 주고, 잘못되면 책임도 집니다. 보증금이 큰 원룸이나 오피스텔 계약이라면 수수료를 내더라도 이 경로가 안전합니다.
If you sign through an agency, the agent does this checking. They pull the register, explain the owner and the mortgage, and carry liability if something goes wrong. For a studio or officetel with a large deposit, paying the commission for that route is the safer choice.
반대로 고시원과 원룸텔, 짧은 월세처럼 보증금이 적은 방은 부동산을 거치지 않고 주인과 직접 계약하는 경우가 많습니다. 이때는 확인해 줄 사람이 없으므로 스스로 봐야 합니다. 대법원 인터넷등기소에서 주소만 넣으면 누구나 열람할 수 있고 수수료는 아주 적습니다.
Rooms with small deposits, like goshiwon, one-room tels, and short monthly leases, are often signed directly with the owner and no agency involved. Then no one is checking for you, so you have to look yourself. Anyone can view the register on the Supreme Court's internet registry by entering the address, and the fee is very small.
근저당권이 잡혀 있다고 무조건 나쁜 계약은 아닙니다. 다만 그 금액과 내 보증금을 더한 값이 그 집값에 가까우면 위험합니다. 부동산을 끼고 있다면 이 집 근저당이 얼마인지 소리 내어 물어보십시오. 직접 계약이라면 등기부등본을 떼어 그 숫자를 눈으로 확인하십시오.
A registered mortgage does not by itself make a bad contract. It becomes dangerous when that amount plus your deposit approaches the value of the property. If an agent is involved, ask out loud how much the mortgage on this place is. If you are signing directly, pull the register and see the figure with your own eyes.

등기부등본은 등기부의 등본입니다
The property register copy is a copy of a register
번역기는 이 말을 대개 property registration certificate으로 옮깁니다. 그러면 무언가를 증명해 주는 증서처럼 읽히는데 실제 성격은 다릅니다.
Translators usually render this as property registration certificate, which reads like a document certifying something. Its actual nature is different.
등기부는 국가가 관리하는 장부이고, 등본은 그 장부를 그대로 베껴 낸 사본입니다. 즉 등기부등본은 그 집에 관해 나라가 적어 둔 기록을 통째로 복사해 온 종이입니다. 누가 주인인지, 빚이 얼마인지가 적힌 순서대로 나옵니다.
등기부 is a ledger the state maintains, and 등본 is a copy made from it exactly as written. So 등기부등본 is a sheet carrying the whole of what the state has recorded about that property: who owns it and how much debt sits on it, in the order it was entered.
그래서 뗀다고 말합니다. 발급받는다가 아니라 떼어 온다입니다. 등본 떼다, 주민등록등본 떼다처럼 씁니다. 창구에서는 등기부등본 떼러 왔는데요라고 하면 통합니다.
That is why Koreans say 떼다, to tear off, rather than to be issued one. You use it as 등본 떼다 or 주민등록등본 떼다. At the counter, 등기부등본 떼러 왔는데요 works.
Special Clauses to Put in the Contract

특약은 계약서 아래쪽에 손으로 덧붙이는 약속입니다. 넣어 달라고 말하면 넣어 주고, 말하지 않으면 비어 있습니다. 하루의 공백을 메우는 것도 여기서 합니다.
Special clauses are promises added by hand at the bottom of the contract. Ask and they go in; say nothing and the space stays empty. This is also where you close that one-day gap.

중개사가 먼저 특약은 뭐 넣어 드릴까요라고 묻는 경우가 많습니다. 그때 준비한 문구를 그대로 말하면 됩니다. 외국인이라 어렵게 말할 필요가 없고, 종이에 적어 가서 보여 줘도 됩니다.
Agents often ask first what clauses you want. Just say the wording you prepared. There is no need to phrase it elaborately, and writing it on paper to show them works fine.
임대인이 거절할 수도 있습니다. 거절 자체가 이상한 일은 아니지만, 첫 번째 문구를 끝까지 거절한다면 그 이유를 물어보는 편이 낫습니다.
The landlord may refuse. A refusal is not strange in itself, but if the first clause is refused outright, it is worth asking why.

The Filings That Come After Signing

신고는 셋으로 보이지만 실제로는 둘로 줄어듭니다. 온라인으로 전월세 신고를 하면 확정일자가 함께 부여되기 때문입니다.
It looks like three filings but comes down to two. Filing the lease report online gives you the fixed date stamp at the same time.

계약일과 입주일이 다른 경우가 많습니다. 짐을 옮기고 그 집에서 자기 시작한 날이 기산일입니다. 온라인 신고는 처리에 사흘 정도 걸리며 토요일과 일요일, 공휴일은 세지 않습니다. 기한 끝에 붙여서 하지 말고 여유를 두십시오.
The signing date and the move-in date often differ. The count starts the day you moved your things in and began sleeping there. Online filing takes about three days to process, not counting Saturdays, Sundays, and holidays. Do not push it to the edge of the deadline.
계약 명의자가 본인이 아니면 서류가 하나 더 붙습니다. 숙소를 제공한 사람의 확인서와 신분증 사본입니다. 기숙사나 회사 숙소, 친구 명의의 집에 들어가는 경우가 여기 해당합니다.
If the contract is not in your name, one more document is required: a confirmation from whoever provided the housing, plus a copy of their ID. Dorms, company housing, and a place in a friend's name all fall here.
기한을 넘기면 과태료가 붙습니다. 전월세 신고는 늦거나 하지 않으면 2만원부터 30만원까지이고 거짓으로 신고하면 최대 100만원입니다. 체류지 변경신고도 과태료 대상입니다. 다만 늦었다고 포기하지 마십시오. 지금이라도 하는 편이 훨씬 낫습니다.
Missing the deadline brings a fine. For the lease report, filing late or not at all runs from 20,000 to 300,000 won, and a false filing up to 1 million won. The change of residence report carries a fine as well. Still, do not give up because you are late. Filing now is far better than not filing.

신고와 등록은 다릅니다
신고 and 등록 are not the same
영어로 옮기면 둘 다 registration이 됩니다. 그런데 한국어에서는 하는 사람이 다릅니다.
In English both come out as registration. In Korean, who does the act is different.
신고는 내가 알리는 쪽입니다. 전입신고, 전월세 신고, 체류지 변경신고가 모두 그렇습니다. 내가 가서 이렇게 되었다고 알리면 끝나며 기관의 허락을 기다리지 않습니다. 그래서 기한이 붙습니다.
신고 is you informing them. The move-in report, the lease report, and the change of residence report all work this way. You go, state that this is now the case, and it is done; you are not waiting for approval. That is why deadlines attach to it.
등록은 기관이 장부에 올리는 쪽입니다. 외국인등록, 부동산등기가 그렇습니다. 내가 신청하면 심사를 거쳐 기관이 올려 줍니다. 신고는 알리는 일, 등록은 올려 주는 일이라고 기억하면 창구에서 헷갈리지 않습니다.
등록 is the office entering you into a ledger. Alien registration and property registration work this way. You apply, it is reviewed, and the office enters it. Remember 신고 as informing and 등록 as being entered, and the counter stops being confusing.
Getting Your Deposit Back When You Leave

보증금은 나갈 때 돌려받는 돈입니다. 그런데 나가는 날 그냥 돌려주는 것이 아니라 미리 말해 두어야 준비됩니다.
The deposit is money you get back when you leave. But it is not simply handed over on moving day; it gets prepared only if you give notice in advance.

If it stays a phone call, you may later hear that no one was told. Send one line by text after the call and that becomes your evidence. There is no need to write long Korean, just the date and the fact that you are leaving.
보증금을 제때 돌려받지 못하는 상황이 생기면 혼자 판단하지 마십시오. 주택도시보증공사와 지자체 전세피해지원센터에 상담 창구가 있습니다.
If the deposit does not come back on time, do not handle it alone. The Korea Housing and Urban Guarantee Corporation and local deposit-fraud support centers have counseling desks.
